* Flicks.co.nz (the site), Flicks.co.nz mobile site (m.flicks.co.nz) and iPhone application is provided and distributed on an “as-is” basis, with no guarantee or warranty of any kind, either express, or implied, including without limitation, warranties of title or implied warranties of merchantability or fitness for a particular purpose. You acknowledge that use of the service is at your sole risk.
* We do our darnedest to ensure all film, cinema and movie time information is accurate but neither Flicks.co.nz Ltd nor any advertiser or associate accepts liability for information that may be inaccurate.
* You accept all risk and liability for all information that you retrieve or use from this website and all comments and reviews posted to this website.
* Flicks.co.nz does not operate any online cinema ticket (or other) booking or pay services.
* Flicks.co.nz contains many links to related or sponsored websites and resources that are not directly associated or managed by Flicks.co.nz Ltd. We are not responsible or liable in any way for the availability and contents of any links outside the domain of Flicks.co.nz.

* Flicks.co.nz complies with relevant copyright laws. Should we receive a claim of infringement, we will review it and remove any content which is in violation of such laws.

SUBSCRIBER & MEMBERSHIP TERMS

Subscribing to Flicks.co.nz refers to signing-up to receive our emails. Membership refers to creating a user profile.

1. You are required to provide an email address in order to subscribe. By ticking 'Sign-me up' on a Competition entry or by ticking the email subscription during Membership sign up, you agree: a) to be bound by these Subscriber & Membership Terms and the General Terms & Conditions on this page; b) to receive email communications from us.
2. You can unsubscribe from email communications at any time by deselcting the option in your Membership profile.
3. Any of the details you provide in your Membership that are specified private, shall remain private, kept secure and not shared with any third party. You can change any of your Membership or log-in details at any time.
4. You can request your Membership profile be deleted at any time.
5. These conditions may only be broken with the express consent of the user, or by court order.
6. You or Flicks.co.nz Ltd may terminate this agreement at any time. Without limiting the foregoing, we have the right to immediately terminate any subscriptions or memberships in the event of any conduct by you which we, in our sole discretion, consider to be unacceptable, or in the event of a failure by you to comply with any of these terms.
7. We reserve the right to change, alter or modify these Subscriber & Membership Terms at any time.
8. These Subscriber & Membership Terms are governed by and will be construed in accordance with the laws of New Zealand and you submit to the jurisdiction of the courts of New Zealand.

GENERAL PRIVACY STATEMENT

* Flicks.co.nz is committed to maintaining the privacy of our users. We respect the NZ Anti-SPAM legislation and all its admirable intent, and our services comply with these fundamental principles: a) Your information is never used for purposes other than those for which it was originally collected; b) Your personal information and email address is never shared or distributed to unauthorized parties, and is kept private and secure at all times.
* These conditions may only be broken with the express consent of the user or by court order.

CONDITIONS OF USE - REVIEWS, COMMENTS, MEMBERSHIP

You accept sole responsibility for all your activity on this website including the content of reviews,  comments and membership profile entries posted by you. In your use of this website, you agree not to:

1. Harass or threaten anyone or spread untruths about other people
2. Intentionally behave in such a manner as to cause upset and/or offense to other people
3. Use hateful and discriminatory language
4. Hack into any part of this website
5. Impersonate someone else or claim the identity of a person who is not you
6. Break any law, whether local, national, or international
7. Post content that you are not the author of, or do not have permission from the original author to post
8. Claim authorship over content that was not created by you
9. Advertise or promote goods and services
10. Use the website in any way that associates with or propagates spam or any other activity causing disruption of network services and/or annoyance and frustration to other people using the service
11. Breach any applicable law

* We reserve the right to remove content from the website which violates these terms and conditions (or that we deem otherwise inappropriate) without notice, for any reason, at any time.
* We reserve the right to block, or ban outright individuals who violate these terms without notice, especially in the case where there is evidence that the same individual is repeatedly and wilfully engaging in disruptive behavior.

COMPETITION TERMS OF ENTRY

1. No purchase or fee is required to enter. By entering the competition, you accept these terms and conditions.
2. Entry is through the competition entry pages of the Flicks.co.nz website. Winners will be notified by email. A valid email address must be submitted via the entry form.
3. Prize winners will be determined by a random draw from all correct entries received before the closing date. Prizes not claimed in a reasonable or specified duration of time may be re-drawn. The winner must be able to take the prize as is, when is, as stated or else it is forfeited.
4. Judges' decision will be final and no correspondence will be entered into.
5. Prizes can’t be exchanged for cash or other property and are subject to the terms and conditions and refund policies of the advertiser or promoter that is sponsoring the competition or providing the prizes.
6. Each winner acknowledges that neither Flicks.co.nz nor advertisers and competition sponsors accept responsibility or liability for any harm, damage, expense, loss or injury which may occur as a result of the winner claiming the prizes and/or using the prizes. Each winner shall accept and use the prizes at their own risk.

LAW

These terms and conditions are governed by the laws of New Zealand, and the parties submit to the non-exclusive jurisdiction of the New Zealand courts.
